Which brings me to your example... to extend it a little: "Your honour, I admit I crashed my car into a shop window, but it's not my fault caused I was too ....... drunk to realise what I was doing!"
Regarding intent, the reason it's not a good idea to include it is best summed up by the adage: "Justice must not only be done, but must also be seen to be done." Whenever there is a mob, perception is reality and the best way to deal with doubt is to limit yourself to the established facts.
But Ok, since you've given me a platform I'll use it...
In another post (wall of text) I mentioned that morality is just made-up .... that happened to work. It provided a context for civilisation to evolve by allowing people to live together in large numbers without killing each other -> civilisation
Morality is not a physical thing, it's a contract. And in this contract, perception is reality. If we live within the bounds of morality we get the protection of society. But if you have enough talent, then you might say: ".... that, I don't need protection". And so guys like VR or MM might chose to invent their own morality to get what they want. So, Ok, they lose protection; they lose support. So next time they need a break from their fellow competitors, or their fan base or sponsors... maybe they won't get it. Or maybe they will. That's political capital. That's popularity.
The difference on this occasion was that both guys were perceived to have stepped outside the social contract, but only one of them broke the rules of the tv show, so: eeehhhhh! thank you for playing, go to the back of the grid please.

I'm in favour of keeping things fact-based and reasoning about what happened because it's ....... good learning, that's all. I'm not a believer from either side. But, having said that, I think it's worth mentioning the bigger picture: like it or not, the motogp tv show owes a lot to the promotional energy and genius of Valentino Rossi: the motogp brand and the personal brand and earning power of everyone in the paddock would not be what it is without the cult of personality around VR. So, those indignant, diminutive Spanish gentlemen would do well to remember that. They wouldn't have tailor-made clothes for example, they would have to suffer the indignity of shopping in the boys-wear department well into their dotage.
So here's my view... yes, it's good learning if we stick to the facts in our analysis, we will all be a bit wiser if we do. But hey, these guys are human and sometimes they get mad and .... up, and sometimes they stay mad and keep ....... up for a while. OK... fine with me. I'm not going to apply some arbitrary morality to label them, because I'm not deluded into thinking that it's a real thing. I understand it for what it is and if I'm lucky, I learn something.
