That is exactly what he did in track terms, the checkerred flag is the light that tells you slow the .... down.

The chequered flag means the session/race has ended, it does not mean you should slowdown although one would well suspect that a rider would both slow down somewhat (and MM says he was in 4th not 5th - still to quick) and be wary of other slower riders and it is here where failure occurred.
The only flags under which a rider is instructed by race control to slowdown (at the riders briefing) are the Red/Yellow flags as these indicate a potential hazard.
But, none of the above excludes that MM made a major error and, in my opinion is 100% responsible for the incident and should be penalised accordingly, but what/where is the precedent?
