If someone is caught cheating and receives a penalty, it's a dead issue. If the rider accumulated enough points that he still wins the championship even though he was penalized, he still earned the championship. The penalty is supposed to nullify whatever advantage the rider may have received while breaking a rule.
 
Just like some people feel it's BS that if Race Direction found evidence of MM deliberately attempting to slow Rossi he wasn't penalized at all.

This is normal in sports, it's like not agreeing with a ref's call on the field.

Now, the issue again reverts back to the penalty and if (what I feel) had been a fair penalty applied (which of course is not the case) then VR would be behind JL in points so if JL were to crash out, VR would need to attain a set points. As it sits, despite the yellow tainted opinions, VR still hast he upper hand

It must be remembered that a a championship is an accumulation of points from throughout the season based on the finishing positions, and as such, with the penalty applied VR still has accumulated enough points to be leading (certainly, not all of us like it, but 'dems the facts unfortunately')

There have been exceptions (not championship changing) where riders have lost points after the season has ended, generally for drug type offences (West for example), plus of course there is the risk that a rider may transgress in the last round and be docked points that could affect the position, or an appeal could be completed (and go against the appealing rider)

But agree with the premise
