MM vs VR incident – still too many unanswered questions?

Did they strip Karel Hanika of his points after admitting causing a crash on purpose and receiving 5 penalty points on his license?!! I know the answer to that, can you guess?!!
I don't know who is Karel Hanika nor do I need to care what they did to him. If he did the same, he should have been stripped of all his points. If this didn't happen, the regulation in motorsport is a joke. Why the hell do you need rules if you get such a ridiculous penalty after doing the worst possible breach of rules possible ? Seriously, if kicking a driver out of track is only 3-5 penalty in driver points, than when are you gonna blackflag someone ? Maybe in order to blackflag someone you need to .... your opponent and kidnap his son ?

This is why Rossi may have a chance taking this to the CAS, the idiots in race control and the FIM stewards are now saying that they didn't look at the telemetry or even request it. Race control and the FIM stewards have to be the biggest group of idiots on the planet. Every other sport is using everything at their disposal to decide these things.
You can't punish someone without looking at all the evidence, this is basic stuff that the FIM stewards should have looked at instead of going off how terrible the initial incident looked when everyone thought that Rossi actually kicked him, it's obvious what they thought when coming to a decision that quickly. Some people still maintain that he actually is good enough to kick a handle bar while leaned over and not looking at the handle bar. Just as insane as the people who think MM laid down an intentional head butt. This could come down to a technicality.

Hawk, if RD felt that Rossi had kicked Marquez off the bike (I do not support that claim) thence they are negligent for not Black Flagging him immediately, instead they did what I feel is correct under the circumstances and review the footage, speak with the riders and so on.

Whilst I am surprised that they did not call for or have the telemetry (if correct), one factor still remains which was Rossi's very words that yes he slowed to a near stopped pace to confront Marquez.

Irrespective of whether one thinks there was provocation or one thinks there was not, those words were said by Rossi to Race Control and in subsequent interviews.

CAS will put a stay as they should but the words themselves may come back to haunt as the very words add suspicion to action

Rossi already admitted he ran MM wide. The kick is peripheral to the whole issue, as it would seem Rossi is contesting his penalty, not his actions.

Rossi did the right thing to appeal to CAS - and by that I mean the right thing for him and only him

He knew that the CAS cannot make a decision within a week and as such if they allow the stay of the penalty then he gets 'all systems normal' for Valencia and by the time any decision is handed down, the incident is long at the back of everyone's minds (and it will despite that which we say)

I personally think it is a joke that a Court can rule on sports but it has been used in the past for many sports and no doubt will again ........... one cannot blame Rossi for trying every option

It's just that it's a turd of an action. Haga got rubbed out and didn't go to CAS, nor West...and those were for off-track misdemeanours. Outside RD control.

Re: The Hanika thing. That was another example of RD weakness. Punt a guy off, bust his bones...and get a pit lane start only? The only mitigating circumstance is that it didn't affect the race result. Except for Guevara, who busted his collarbone. Weak as piss.

Absolutely no argument from me on that.

One only hopes that FIM learn from the outcome (positive or negative) as if in the end it brings greater clarity to a rule or how/when to enforce it, all well and good

The big issue I have with courts determined results within sports is that the court must adjudicate based on the written rule but will often throw their interpretation or definition onto key words. This is where things can become confused as what you or I may consider one thing, a court may decide on another.

Either way, we will find the result in 2016

Don't fear the bolded, know it will be the case.

If the penalty is ruled 'unjust' or unfair thence RD will now be very hesitant to take any actions in similar circumstances lest they have to go through the same process (remembering that this will cost dollars to attend and present their case)

I don't envy RD, but their inability to make a timely decision in this case has increased the kerfuffle.
The point system is something I've never agreed with as it allows incidents to be pushed away, with RD out of the firing line for enforcement. In race incidents nèed to be dealt with in race as far as practical.

First of all, there is no evidence that Marquez was holding Rossi up on purpose. That's just another peace of ........ coming out of Rossi's big mouth. Of course you go both slower when you are fighting each other. That's normal and part of racing. If Rossi wants his opponents to move aside from him, then maybe he should stop motos and start ballet.

Secondly, Rossi never had the pace to challenge Lorenzo or Pedrosa. Even after Marquez was out of the race, Rossi was slower than both in every lap of the race (with exception of 1 lap). In fact he gained points by kicking Marquez out of the race because Marquez would have been third.

Thirdly, the rules are the rules and even if Marquez would hold Rossi up (again there is no proof for this, just liar Rossi claims it), then still Marquez can do that because it is not against the rules; and secondly, that doesn't give you permission to kick a rider off his bike.

Fourth, if Rossi would not have driven like an ....... the whole year and ...... up Marquez championship and at the same time stop being a little ..... in press conferences, this situation would never have occured. "you sow what you reap".
