Kevin Schwantz FB Statement Regarding COTA

KS tried to mingle himself as a middleman and failed.

COTA can restrict access to it's facility to anyone as they wish, it's their facility.

Friend, I suppose when you have been wronged that you will be quiet and just let the judge be the arbiter.  I mean, because they always side with justice, right?  KS is a public figure and this mess has become a public interest.  The man is accessible through public media, and many people have an interest in his affairs.  That he is willing to speak frankly about it to his fans, followers, and generally interested public is not something I find unseemly.

Because contracts have never been disputed?!?  With all due respect, a contract to slime generally means it "binding" if they 'feel like it'.  Especially if one has a sea of lawyers on retainer for the .... of it, knowing that legal maneuvers most often generally result in the submission and acquiescing of the less funded party.

Friend, I'm glad KS is giving us the scoop.  I find nothing wrong with it.  To the contrary, I find it refreshing.  Especially because given my experience, there is a much greater likelihood that the COTA executives are ....... him over.  I would direct you to some of the property owners adjacent to the circuit, as they might be more convincing that these COTA executives are .......s.

Fair point Jum, to be honest i was two bottles of merlot in when i posted yesterday.

Hey whats up Shov? U gonna join us in Austin buddy? Ok, heres my take bro, The only thing he "failed" was to assume these business men operated under rules of decency. These high powered excs operate in a way unfamiar to most people, apparently from ur suggestion above, even u. The world of "middle" men exists in just about every transaction we engage. Its obvious KS's involvement was driven by a place of passion for the sport, the one u & i travel around attending. Its abundantly obvious they used KS then hung him out to dry.

I understand the concept to "revoke". However, it sounds like KS secured the proper credential. To issue then revoke it may be in their stated 'right' but is certainly chickenshit.

The bottom line is that COTA is a private entity and can restrict it's access to whomever they want regardless of who they are.

If the circuit doesn't want someone on their grounds, it is irrelevant what credentials they have in their possession.

btw..Austin F1 tickets go on sale in 8 minutes, General admission sold out fast last year.

No worries brotha. I get what ur saying about making things public though. I feel the same as u with 'other' celerities. (double standard perhaps on my part) My gut feeling is simply this is a bit different since hes exposing these exces for slimeballs.

I could have used some merlot yesterday. ;)

Perhaps.... The world of legal .... is not an exact science. The teams entered into a 'contract' to test. Im sure that contract is a long document coving all maner of stipulations & requirments. This means both parties are agreeing to something rather complex, and im sure part of this was to allow the personnel the teams deemed necessary for the task . Its not uncommon for one party to then not uphold their end of the deal. Newsflash buddy, even the supreme court is more often than not split on what is what. So ur opinion that they had the undisputed right to revoke access because they are a "private" entity is actually debatable if a contract was signed to allow the teams to bring in specific personnel of their chosing. In fact, if this is the case, issuing a credential to later revoke it is actually advantage KS. So ur "bottomline" is not as black & white as u may think. Read the last 10 cases brought to the supreme court. Most of these have been judged on opposite ends by several courts before they make it up to the top. And when they are decided, the decision is usually split. So who is right? God know, eh brotha...

Anyway, u didnt answer my first question.

<span style="color:rgb(68,68,68);font-family:Arial, Helvetica, sans-serif;font-size:12px;Yeah,  the "it's COTA's property..." and "If a homeowner threw a party..." arguments are flawed, imho. These teams weren't houseguests. They were paying customers, for whom Schwantz is a consultant/coach.

<span style="color:rgb(68,68,68);font-family:Arial, Helvetica, sans-serif;font-size:12px;A more appropriate comparison would be if someone rented out their house and then tried to specify to the renter which of their friends or business associates they could have over.

<span style="color:rgb(68,68,68);font-family:Arial, Helvetica, sans-serif;font-size:12px;Attack can now argue that they did not get the full use of COTA because they were denied access to an invited, credentialed team member (even if only an intermittent one) during critical testing/training evolutions.

I would be willing to bet that KS's Cota credentials for the test were in form of a generic team pass, not an actual "Kevin Schwantz" pass.

I'm going to Austin for the Gp and will NOT be wearing any KS .... on me.

If the team were issued generic passes to use as they see fit, then ur point is irrelevant. Did the track have a previous restriction or restraining order? It seems rather laughable knowing KS is involved in GP that it would be overlooked that he might be involved in testing.

I know how much u love ur DeAngelis jersey. I wouldnt expect u to wear anything else.

Don't know about Schwantz, but they tried unsuccessfully to get an injunction to keep Hellmund out during F1. FOM controlled the Paddock, Paddock Club, and everything inside the track, and they welcomed both Hellmund and Schwantz with open arms...much to COTA's chagrin, I am certain.

Good article on the subject on asphalt and rubber

prob posted on motomatters as well.  I'd have to agree with wat the article says tho.

no time to elaborate sorry

Hey bro, I'm not so sure this was a "good article".  I'm not even sure its worthy to call this 'journalism'.  I think this guy has as much insight as your standard forum opinion.  Hardly an article/opinion piece with any substance actually.  I think Its a hack job by some gutless media wanabe trying to stay in the good graces of COTA more likely.  What facts did this "journalist" bring to the table here?  Nothing, just his opinion on the matter, and a poor one at that.  I don't expect many or any sport journalists to give us much scoop as they are usually puppets to the league and the league's preferred associates.  The media are usually used to dispense the messages that the executives scheme up for propaganda purposes because journalists and ignorant public are easily manipulated (and in some cases willingly or paid insider lobbying, tow the corporate line).

Its no wonder why some of these high powered execs get away with it over and over again, as not only do they have a sea of lawyers to frustrate the process using legal tricks, but with a few carefully placed media hacks can garner public support  to convince people they are in the right. Politics 101.

Interesting, I was just looking up <span style="font-size:18px;Jensen Beeler.  Jesus, can this guy's motives be any more clear?  He was the first to post a comment on David Emmet's article here: http://www.asphaltandrubber.com/racing/dorna-kevin-schwantz-cota-motogp/

Notice he is trying to sell us, like Shovelhead above, that 'cutting out the middleman' is just standard acceptable business practice and we should all just move along and get over it.  Lame.

Whats up Shov?  Are you worried COTA will take away your pass to the track?  Hahaha  KS is not infallible, only the pope is that; but its abundantly clear that he's getting ...... on this one.  Did you finagle some deal with COTA or something?  Perhaps you finagled a bunch of VIP passes and are clucking (see urban dict) them and want to be sure you stay on the good graces of the track?  I know there has got to be some angle in it for you buddy.

Tex, is this the same dude? Not sure.
