Honda: Data shows Rossi kick on MM

I have no doubt he will get a stay

Effectively he has appealed the penalty which means the imposition of the penalty as he is claiming to harsh (as I understand - and I have not read to in depth) he is not appealing the finding.

Thus to me, he will get a stay of the penalty purely as if he does not get the stay, then there is no need for the appeal as the reason why he needs the stay has now passed. Generally courts will allow appeals and will place findings on hold or stay in matters of this

I will be more surprised if he does not get the stay as if that occurs then really he may as well withdraw the appeal

Mind you, I do not know the machinations and what is being presented etc so am basing things on little knowledge but believing in fair and due process.

Well he's appealed for the penalty to be reduced to 1 or wants it abolished completely...... I'm guessing he admits fault of being in the position on track but does not admit fault for being the cause of the crash...?!

Which may throw a light spanner in his works ........... as (just as you suggest) that would seem that he is admitting guilt and thus contributory

It will be interesting to say the least and as I was saying, if the stay is not allowed, both what next and then does he withdraw the appeal

Can you imagine however that if the stay is not allowed, the number of rabid fanbois (not racing fans) and their reactions

Well I'm a huge Rossi fan but if he starts from the back I say fair enough... But what does look disappointing is that Yamaha wanted RD to talk to MM and VR before sepang to make sure this incident didn't happen and it did because they failed to see the relativity of it.... If that chat took place this might not of happened.......

I mentioned it elsewhere but for that to happen and not to be seen as a 'pandering' situation etc there were two things that should have occurred.

1. Rossi should not have gone public on Thursday
2. Yamaha needed to put a formal complain into RD as that then means that they (RD) must act and that any conversations are due to the formality of the issue and not 'heresay'

Given that Yamaha made the approach on the Saturday it was to late ........ Rossi had flogged the horse and made it bolt on the Thursday

Anything that occurred after that and without a formal complaint would have been seen as 'pandering' to Rossi and/or his wishes.

The press conference and Rossi's public accusations painted RD into a serious corner as if they listened and spoke with Marc it would seem that they were 'responding to Rossi' and by doing so, treating him different to other riders who have opinions or grievances. If they spoke with Marc 'off the record' he would know where and what precipitated the chat and as such be even more riled at what he would see as RD 'believing' Rossi and doing 'Rossis work' (so to speak)

My opinion, and likely an unpopular one but if Rossi had NOT have gone public on Thursday but instead raised the concerns through his team, RD may have had some leeway but personally, I still suspect that little would have changed as it is two large egos battling for their own personal supremacy.

Of course, a person's side of this is also borne as to whether they beleive that MM 'played' with Rossi at PI/Sepang - on that score, I remain unconvinced


Edited to add - I am no fan of Rossi the person or personality (have reasons based on experiences) but will not question his riding and nor am I a fan of Marquez the person

The thing is Rossi told Lin Jarvis of his concerns after P.I but Yamaha didn't warn Rossi to keep it to himself... Ultimately Rossi's decision I suppose, but where I think differently is RD talking to them both wouldn't suggest they side with Rossi it would just be a chat where Marquez could be told not to react to the comments that were made, especially on the track with the whole world watching.... because it was an obvious reaction I think most people would have executed to be honest... I know I would! But if a seed was planted before hand, with Rossi also regarding any provocation then maybe this could have been avoided!!

I'm as gutted as can be, not because Rossi has blown his chances of the title but I feel it's a very sad end to a great season, with great riding from what seemed a great group of top sportsman that respected each other..... Now how wrong was I! Looks like they all hated each other all along!!!

You make valid points but Rossi and Stoner were fighting for the race win towards the end of the race..... MM was riding in that manor for 3rd position between 4-7 laps into a race..... There was no need for it, Rossi didn't want to lose touch of the front 2, MM didn't give a .... about the front 2, his whole race got personal with 1 guy........ No comparisons can be made to it.......

Entirely my point. The rules have to be the same regardless of the identities of the riders and their purported motives, and if this is to change mindreading ability will have to be a requirement to be appointed To RD.

It may well have been unreasonable for MM to be racing Valentino so hard in the circumstances, but he did nothing illegal and nothing which Valentino hasn't done in the past, and in fact received acclaim for doing in the past from the same people whining now. Stoner was undoubtedly frustrated at LS 08, and I am sure based on practice times had a fairly reasonable expectation that he could go much faster than Valentino if he got past him, but he didn't and would not have got away with forcing Valentino off the track.

Without a formal complaint RD are genuinely hands tied at this level as if they responded to every comment from teams or riders they would likely be talking to 5 - 10 guys per weekend, for what are not rule breaches but effectively no more than hurting a person's ego in some way, shape or form.

My honest view is that Rossi tried an age old tactic he has used in the past by taking to the media something that could well have been handled vastly differently but whereas in the past he had sympathetic media ears, this time he did not for a number of reasons. Sure some oft he reasons relate to MM being the 'new' wonderkid but I suspect that the biggest reason was that the vast majority of media present just did not see what Rossi claimed had occurred (as an example, look at the different media responses to the incident). He effectively blindsided everyone with what, even now to many is a seemingly absurd statement to make given the history of himself and the sport (again, each has their own take on that)

To me however an even bigger mistake was that he underestimated the impact that it would have on MM. Where in the past when he has gone public in this type of manner (Gibbers with the start line issue, Biaggi many times, CS, JL etc) the riders have either been demonised enough that the media fell into line with the comments or the comments did not 'phase' the recipients. In this case however he chose a very large ego who has been allowed to escape sanction in years past and has been so highly groomed that rules were changed (allegedly in case DORNA are watching) to allow him top go direct to a factory bike.



I'm as gutted as can be, not because Rossi has blown his chances of the title but I feel it's a very sad end to a great season, with great riding from what seemed a great group of top sportsman that respected each other..... Now how wrong was I! Looks like they all hated each other all along!!!

He remains 7 points in front in the title which is critical point #1 for mine as it means that Lorenzo MUST beat him and beat him well where as he only needs to be concerned about Lorenzo.

Certainly in the current format with only 4 bikes in with a realistic chance (the Ducati is on the periphery if it shows up) then his job is hard, but it is not impossible and nor is it ridiculously unlikely for to me, it will need JL in 1st or 2nd for him to win the title (him being JL), unless Rossi falls.

If it means Rossi winning the title after all that's gone on he'll finish where he needs to and see JL wins, I honestly can't see any other outcome... Also Valencia isn't easy to pass at and coming from the back I don't think is easy in any way at all!

This is where we part company. I think an argument can possibly be made for MM racing VR unreasonably hard at Sepang if he did have the ability to run away from Valentino which will never now be established, but VR's Thursday press conference remarks were quite unreasonable in themselves, not very arguably an attempt to influence the nature of further racing by off-track means, entirely likely to diminish any championship win by Jorge, it could be argued provided an excuse for VR if he didn't win, etc. it wasn't all that unpredictable that it might embolden MM for that matter either.

That's actually a very good point, there has been some discussion of how long it took before the complaint was made and the fact that VR's view did not crystallise based on how he felt during the race, but has the point you are making been aired in the media?

The point I mean is that VR chose to air his grievance at the press conference rather than following formal channels.

The thing about a formal governance system is that it depersonalises disputes and transgressions, the judicial process and the delivery of punishment or restitution or constraints. It's an adversarial system, but with representation and the arguing and the deciding is done by non-stakeholders. The idea being that the process is rational and dispassionate and not only fair, but seen to be fair.

It's one of the essential elements that allow socialisation to work.

I don't know if there is a code of conduct for motogp, that covers things like public statements, accusations, dispute resolution and bringing the competition into disrepute, but there should be. If I were a sponsor, investing money and associating my brand with the competition, then I would certainly either demand that or, if I didn't have the pull to insist, absolutely log it as a serious risk.

So, I think it would be good to call Rossi to account on his choice to take matters into his own hands in total disregard for the motogp governance systems. I would suggest that the playing field in resolving the dispute would be massively tilted in his favour by choosing the route that he did. And I would characterise that tilting as bias.

Speculate all you want about Marquez's intent but, when Rossi made that choice, the possibility of resolution was massively reduced and the potential damage to all stakeholders massively increased.

I would expect to see codes of conduct to be added to all contracts in the future or clarification and strengthening of the penalties if they already have them.

See, this is where I have a major difference

Marquez is NOT riding for Lorenzo but I do accept that Marquez is riding for Marquez only and if that means he wants to fight with Rossi, then so be it and as long as it stays within the written rules ...... all good.

As for passing, I suspect given all that has gone on in the first few laps it will be easy up until he gets to around 12th or so and from then on, we shall see as whilst VR will have the bike and the attitude, the bikes up there are a little more competitive than the open class machines

If you are correct and VR does not win the title, I would not want to be near Valencia
 
I was just thinking about Rossi's explanation of MM's supposed vendetta against him. The whole thing is so self-flattering and self-congratulatory that it makes Rossi look like an ego maniac who is losing it because he lost his dominant grip on the sport years ago.

Marquez is battling him because he is jealous of Rossi's record and doesn't want him to add to it. Hell, The Doctor even thinks MM93 passed him in the corkscrew at Laguna Seca to imitate Rossi's actions five years earlier!

His paranoia is pretty funny!

Yeah, don't dish it out if you can't take it. Somehow I can't see the great Hailwood moaning like Rossi has were he still around.

Rossi's biggest mistake was leaving it to the end of the season to boot the little .... off ! Should have done it ages ago.
